xAI Takes Legal Action Against User Accused of AI-Generated Child Abuse Content

This litigation represents one of the earliest instances in which a technology corporation has pursued legal action against consumers suspected of generating explicit visual content through artificial intelligence systems.
According to the legal filing, xAI contends that Terry Wayne Harwood contravened the company’s established terms of service by transforming ordinary photographs into sexually explicit imagery without obtaining permission from or informing the individuals depicted in those original images. The lawsuit documents that Harwood, together with three additional men, faced arrest earlier this year within South Carolina on numerous charges related to the alleged sexual exploitation of a minor.
Details of the Legal Complaint
The civil action was submitted to the United States District Court for the Northern District of Texas. The complaint asserts that Harwood established several separate xAI accounts and utilized what the company characterized as “misleading prompts” to produce explicit deepfake imagery encompassing both adult and juvenile subjects. Furthermore, the legal document claims that Harwood crafted these prompts specifically to “circumvent” what xAI described as “built-in safeguards” designed to prevent the generation of explicit material featuring minors.
“Defendant breached the xAI Terms of Service and Acceptable Use Policy by leveraging Grok to generate non-consensual sexually explicit images and CSAM,” or child sexual abuse material, the suit adds.
CNN has contacted the legal representative for Harwood in his criminal proceedings to request a statement regarding these developments.
Grok’s Content Moderation Challenges
Earlier this year, the Grok platform faced considerable criticism regarding a feature that enabled “digital undressing,” a capability that produced AI-generated images showing children in undressed states. This controversy emerged as users observed a notable increase in non-consensual, sexualized deepfake content throughout the latter part of the previous year. In response to these concerns, both Musk and xAI announced intentions to implement measures against such unlawful utilization of their artificial intelligence technology.
“Anyone using Grok to make illegal content will suffer the same consequences as if they upload illegal content,” Musk wrote in a January 6 social media post that was subsequently quoted in the lawsuit.
The alleged misconduct by Harwood reportedly exposed xAI to considerable legal vulnerability and potential harm to its public reputation, according to the legal filing.
xAI’s Proactive Enforcement Statistics
Within the lawsuit, xAI presents data demonstrating its efforts to combat problematic content. The company claims that it “has suspended 52,222 accounts and made 73,604 reports to (National Center for Missing & Exploited Children) in 2026, resulting in (at least) 244 arrests.” These figures illustrate the scale of xAI’s content moderation operations and its collaboration with law enforcement agencies.
The legal action seeks a judicial declaration confirming that Harwood violated the platform’s Terms of Service, alongside unspecified monetary damages. This lawsuit arrives as xAI continues to navigate public scrutiny regarding its chatbot’s performance and content policies.
