CNN warns Trump White House over Air Force One access

Sandego.net – CNN warns Trump White House that it may seek further legal action if the network continues to be excluded from Air Force One travel pools. The dispute centers on CNN’s role in the rotating television pool that provides shared video coverage of presidential events and trips.

The warning follows a federal court order requiring the administration to restore White House access for CNN, MS NOW and Politico while their lawsuit over an earlier ban moves forward. CNN says its restored access has not resolved restrictions affecting its assigned travel-pool duties.

Network says it was skipped for pool coverage

CNN’s outside counsel, Ted Boutrous, wrote to the Justice Department that the network had been passed over on multiple occasions when it was due to provide television pool coverage. The arrangement traditionally rotates among five major television networks, whose footage is used by news organizations in the United States and abroad.

“These efforts to retaliate and discriminate against CNN based on the content of its news coverage are mistaken, counterproductive, and unlawful,” Boutrous wrote.

According to the letter, CNN was scheduled to cover President Donald Trump’s travel to Georgia and Florida over the previous weekend but was not included in the out-of-town press group. Boutrous said the White House provided neither written notice nor an explanation for the exclusions. The Justice Department did not respond to a request for comment Tuesday morning.

CNN warns Trump White House that continued exclusion could require the network to ask the court for additional relief. The network argues that preventing an assigned outlet from joining the pool affects more than its own reporting because other outlets rely on the shared coverage.

Access dispute continues in federal court

The broader lawsuit began after Trump barred CNN, MS NOW and Politico from the White House about a month earlier. The news organizations argued that the restrictions violated the First and Fifth Amendments.

U.S. District Judge Tim Kelly first temporarily restored access and later issued a preliminary injunction for the plaintiffs while the case continues. Kelly found that the ban was likely unconstitutional viewpoint discrimination under the First Amendment. Although the administration reinstated the outlets’ White House access, the Justice Department has continued to defend the original ban in court.

After Kelly’s longer-term order last week, a White House official issued a statement saying that “the Fake News has no place demanding a spot in the President’s Oval Office.”

Air Force One access raises separate legal questions

The administration’s position may be influenced by a separate case brought by The Associated Press, which sued after its reporters were barred from Air Force One, the Oval Office and other presidential locations with limited press space. The dispute followed the AP’s decision not to immediately adopt Trump’s preferred name for the Gulf of Mexico.

In June 2025, an appeals court panel partly lifted a stay obtained by the AP. The panel said the organization was unlikely to prevail because places such as Air Force One and the Oval Office are restricted presidential areas, rather than First Amendment forums open for private speech and discussion.

Boutrous said that decision was non-binding and non-precedential, so it does not control other cases. The full appeals court has not issued its decision in the AP case, although some access for the organization has since been restored.

CNN warns Trump White House that Air Force One, the Oval Office and airport tarmacs have become especially important settings during Trump’s second administration, as the president frequently answers reporters’ questions there rather than primarily through formal briefing-room appearances.

Frequently asked questions

Why does television pool access matter?

The television pool allows one assigned network to record presidential events and distribute footage for use by other news outlets. Excluding a network from its scheduled rotation can limit the shared coverage available to the wider press.

Has CNN regained White House access?

Yes. A federal court order restored White House access for CNN, MS NOW and Politico while their challenge to the earlier ban proceeds. CNN’s current complaint concerns travel-pool access, including flights on Air Force One.

What could happen next?

If the exclusions continue, CNN could seek additional judicial relief, according to its attorney. The underlying case over the White House restrictions also remains active.
