Clancy admitted killing her three children — Cora, 5, Dawson, 3, and Callan, 8 months — by strangulation. She has pleaded not guilty to three counts of first-degree murder, arguing that postpartum psychosis left her unable to bear criminal responsibility at the time of the deaths and her subsequent suicide attempt.

After more than 38 hours of deliberations, the jury could not reach a unanimous verdict. A single juror prevented a finding that Clancy was not criminally responsible, resulting in a mistrial.

Defense Is Open to Hearing a Proposal

Kevin Reddington, Clancy’s defense attorney, said he would listen if Plymouth County District Attorney Timothy Cruz wanted to discuss a plea agreement. Lindsay Clancy’s attorney says, however, that he would not agree to a deal requiring her to go to jail.

“I want to hear what Tim has to say,” Reddington said Wednesday.

Cruz also said strong public opinions about the case should not determine the next legal step. His office must assess the evidence, the prospect of a conviction, the impact on the victims’ family and whether another trial would serve justice.

Daniel Medwed, a professor of law and criminal justice at Northeastern University School of Law, said prosecutors must consider whether a conviction would produce a just outcome. If they believe conviction is appropriate but difficult to obtain at retrial, negotiations involving lesser charges could be considered.

Why a Plea Deal May Be Difficult
